The Control of Major Accident Hazards (Amendment) Regulations 2015

This statutory instrument was laid before parliament on Friday 19th June 2015, & comes into force on Monday 13th July 2015, & amends The Control of Major Accident Hazards Regulations 2015, which was emailed to you on Monday 9th March 2015.

 

EXPLANATORY NOTE

(This note is not part of the Regulations)

The Control of Major Accident Hazards Regulations 2015 (S.I. 2015/483) (“the 2015 Regulations”) implemented Directive 2012/18/EU of the European Parliament and of the Council on the control of major accident hazards involving dangerous substances, amending and subsequently repealing Council Directive 96/98/EC (O.J. No. L 197, 24.7.2012, p.1) (“the Seveso III Directive”).

 

As part of the implementation of the Seveso III Directive, the 2015 Regulations give specified functions to a local authority as defined in regulation 2(1) of those Regulations. These Regulations correct an error by amending, in relation to Scotland, the definition of local authority.

No impact assessment has been prepared for this instrument as its only purpose is to correct an error in the 2015 Regulations.

The Environmental Damage (Prevention and Remediation) (England) Regulations 2015

This statutory instrument comes into force on Sunday 19th July 2015

 

These Regulations revoke and replace the Environmental Damage (Prevention and Remediation) Regulations 2009 (S.I. 2009/153)

 

The Regulations apply in England and in specified marine waters and the seabed (regulations 1 and 6). They specify the types of damage to a protected species or natural habitat, a site of special scientific interest, water or land which constitute “environmental damage” for the purposes of the Regulations (regulation 4) and the types of activity causing environmental damage to which the Regulations apply (regulation 5). There are certain exemptions and exclusions from the application of the Regulations (regulations 8 and 9). The Regulations also specify the authorities whose function it is to enforce the Regulations (regulations 10 to 12).

The Environmental Damage (Prevention and Remediation) (England) (Amendment) Regulations 2015

This statutory instrument was laid before parliament on Thursday 18th June 2015, & comes into force on Sunday 19th July 2015, & amends The Environmental Damage (Prevention and Remediation) (England) Regulations 2015

 

Regulations amend the Environmental Damage (Prevention and Remediation) (England) Regulations 2015 (S.I. 2015/810) (“the principal Regulations”) to extend the categories of environmental damage to include damage to marine waters beyond 12 nautical miles from the baselines in Northern Ireland. They also correct two other defects in those Regulations.

 

No impact assessment has been produced in respect of these Regulations as no, or no significant, impact on the costs of the private, voluntary or public sectors is foreseen. A full impact assessment of the effect the principal Regulations will have on the costs of business, the voluntary sector and the public sector is available from the Energy Development Unit, Offshore Oil & Gas Environment and Decommissioning Branch, Department of Energy and Climate Change, 3 Whitehall Place, London SW1A 2AW and, along with other Regulations transposing Directive 2013/30/EU, is published with the Explanatory Memorandum alongside the principal Regulations on www.legislation.gov.uk.
