What would Health and Safety Sentencing Guidelines mean to you?

Since 2016 courts in England and Wales have had comprehensive sentencing guidelines covering the most commonly sentenced health and safety and food safety offences.

Since then we have seen both the number of custodial sentences and the value of fines being imposed increasing. These can often relate to injuries and not to fatalities

Guidelines relate the size of the fine delivered to:

  • the size of the company,
  • level of company culpability
  • the harm
